The information and documentation available on this web site in English, including these Terms of use, is provided for informational purposes only. In the event of a discrepancy between the content of the English version and the original Spanish version the latter shall prevail.

Accessing and/or using ExamineYou attributes visitors the condition of User and involves the prior reading by the User of the Terms of Use included herein. It is understood that the User confirms his acceptance, expressly, completely and without reservations, of its entire contents.
If the User will be using ExamineYou on behalf of an Organization, the User agrees to these Terms of Use on behalf of that Organization and doing so, the User represents that has the authority to do so. In such case, ‘the User’ will refer to that Organization.
Should the User not agree with the Terms of Use, he shall refrain from accessing the site and/or operate through it.
SERVINFORM, as owner of the site, reserves the right to modify these Terms of Use.
The User commits to access and use ExamineYou, including the contents and/or services, without contravening the Spanish legislation. Furthermore, the User commits to not use ExamineYou for damaging purposes against SERVINFORM. The User agrees that SERVINFORM may audit the use of ExamineYou for compliance with these Terms and Conditions at any time.
SERVINFORM reserves the right to terminate any account for abusive or fraudulent activity.
If the User thinks there has been fraudulent activity with respect to your account, you must contact SERVINFORM immediately.

In compliance with the Organic Law no. 15/1999 of 13 December, concerning the protection of personal data, SERVINFORM is required to inform you that the data entered into the platform by the User will be added and processed in our databases.
This information will exclusively be used for the purpose of providing access to content, services or information in our platform. We may also disclose your information to analyze business results or if required to do so by law or by court or official order.

SERVINFORM adopts appropriate data collection, storage and processing practices and security measures to preserve the integrity and security of your personal information against unauthorized access, alteration, disclosure or destruction.
However, no data transmission over the Internet can be guaranteed to be completely secure. Accordingly, we cannot ensure or warrant the security of any information that you transmit to us.
In the unlikely event that the security of your personal information in our possession or control has been compromised, we will notify you as required by applicable law.
SERVINFORM retain ownership and all intellectual property rights in the site, including without limitation any and all domain names, trademarks, patents, licenses, copyrights, databases, images, graphs, files of any type, software and any other intellectual property, as well as the site as a whole, which is considered a multimedia work for the purposes of integrated national and international rights management.
Any reproduction, distribution, marketing or transformation of the content of the site, which has not been expressly authorized by SERVINFORM, constitutes an infringement of the intellectual and industrial property rights protected by law.
Any infringement of the restrictions or prohibitions contained in the foregoing paragraph shall be considered a breach of the intellectual property rights of SERVINFORM and shall incur the legal responsibilities established to this effect, which may be persecuted by SERVINFORM, which shall be entitled to exercise the corresponding administrative, civil or criminal actions.
SERVINFORM claims no intellectual property rights over the material entered in the platform by User. Content uploaded (including, but not limited to text, images, questions, exams, questions and assessments) remain exclusively User’s intellectual property. SERVINFORM will not use any of these contents, in any form, without User’s consent.
Fees for services. The User agrees to pay to SERVINFORM any fees for each service the User purchases or uses (including any overage fees), in accordance with the pricing and payment terms presented to the User for that service.
Fees paid by the User are non-refundable, except as provided in these Terms or when required by law.
Subscriptions. Some of our services are billed on a subscription basis. This means that the User will be billed in advance on a recurring, periodic basis. Billing cycles are either monthly or annual, depending on what subscription plan the User selected when purchasing a subscription. The subscription will automatically renew at the end of each billing cycle unless the User cancels auto-renewal through your online account management page, or by contacting our customer support team. The User may cancel auto-renewal on the subscription at any time, in which case the Subscription will continue until the end of that billing cycle before terminating.
If the User terminates a subscription in the middle of a billing cycle, the User will not receive a refund for any period of time not used in that billing cycle unless the User is terminating the suscription for any of the following reasons: (a) we have materially breached these Terms of Use and failed to cure that breach within 30 days after you have so notified us in writing; or (b) a refund is required by law.
SERVINFORM may terminate any subscription at the end of a billing cycle by providing at least 30 days’ prior written notice to the User. SERVINFORM may terminate a subscription for any reason by providing at least 90 days’ written notice to the User and will provide a pro rata refund for any period of time you did not use in that billing cycle. SERVINFORM may suspend performance or terminate any Subscription for any of the following reasons: (a) the User has materially breached these Terms of Use and failed to cure that breach within 30 days after SERVINFORM has so notified you in writing; (b) the User ceases business operations or become subject to insolvency proceedings and the proceedings are not dismissed within 90 days; or (c) the User fails to pay fees for 30 days past the due date.
SERVINFORM may also suspend providing the Services to you if we detect or if we are investigating suspected misconduct by the User.
SERVINFORM shall not be responsible for damage and consequential loss caused by the use that users make of the information included in the site.
SERVINFORM tries to keep ExamineYou up and in working condition, but the services offered may be unavailable from time to time for various reasons. SERVINFORM does not provide any guarantee nor shall it be responsible for any damage and losses of any kind or nature that could be caused by lack of availability, maintenance or continuity of operation of www.examineyou.com as well as the incorrect operation of its contents and services.

The User and any other natural or legal person who may foresee to establish any technical device to link their website to www.examineyou.com website must ask for and obtain prior written authorization from SERVINFORM.
The link to www.examineyou.com website neither imply, in any case, the existence of any kind of relationship between SERVINFORM and the owner of the site, nor the acceptance, from SERVINFORM, of its content or services.
The Terms of Use agreement is to be followed and used in accordance with the governmental laws of Spain. In the event that the User is resident outside Spain, SERVINFORM and the User, expressly renouncing any other code of law which may correspond to them, submit to the jurisdiction of the Courts and Tribunals of the city of Sevilla.
